Ce texte vise \u00e0 renforcer la l\u00e9gitimit\u00e9, la transparence et la stabilit\u00e9 des chefferies \u00e0 travers tout le territoire national, en mettant fin aux pratiques d\u2019autoproclamation et en clarifiant les r\u00e8gles de d\u00e9signation, de discipline et de d\u00e9ch\u00e9ance des chefs coutumiers et traditionnels.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">Selon les dispositions du texte, toute investiture, d\u00e9signation ou intronisation d\u2019un chef coutumier ou traditionnel doit se faire dans le strict respect des r\u00e8gles de d\u00e9volution propres \u00e0 chaque communaut\u00e9. \u00c0 cet effet, l\u2019autoproclamation est formellement proscrite, d\u00e9clar\u00e9e de nul effet et passible de sanctions.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">Le projet de loi institue \u00e9galement l\u2019obligation d\u2019\u00e9tablir un proc\u00e8s-verbal \u00e0 l\u2019issue de toute proc\u00e9dure d\u2019investiture ou d\u2019intronisation. Conform\u00e9ment \u00e0 l\u2019article 10, ce proc\u00e8s-verbal doit \u00eatre transmis \u00e0 l\u2019autorit\u00e9 coutumi\u00e8re ou traditionnelle imm\u00e9diatement sup\u00e9rieure ou comp\u00e9tente. Lorsque le chef ne rel\u00e8ve d\u2019aucune autre autorit\u00e9 coutumi\u00e8re, le document est \u00e9tabli par l\u2019instance de d\u00e9signation et transmis \u00e0 l\u2019autorit\u00e9 administrative comp\u00e9tente dans un d\u00e9lai d\u2019un mois.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">Dans un souci d\u2019harmonisation et de clart\u00e9, l\u2019article 13 pr\u00e9voit que chaque entit\u00e9 coutumi\u00e8re ou traditionnelle codifie ses r\u00e8gles de d\u00e9volution et de perte du pouvoir, lesquelles sont transmises au chef de circonscription administrative comp\u00e9tent. Ces r\u00e8gles seront compil\u00e9es dans un r\u00e9pertoire national \u00e9tabli par voie r\u00e9glementaire.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">Le texte consacre par ailleurs la neutralit\u00e9 de l\u2019administration publique dans les proc\u00e9dures de d\u00e9signation, d\u2019intronisation et d\u2019investiture, comme le souligne l\u2019alin\u00e9a 1 de l\u2019article 14. Toutefois, les autorit\u00e9s coutumi\u00e8res ou traditionnelles habilit\u00e9es peuvent solliciter l\u2019appui des pouvoirs publics pour le maintien ou le r\u00e9tablissement de l\u2019ordre public, pr\u00e9cise l\u2019alin\u00e9a 2 du m\u00eame article.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">En mati\u00e8re disciplinaire, l\u2019article 15 conf\u00e8re aux autorit\u00e9s coutumi\u00e8res et traditionnelles investies du pouvoir de nomination un droit de regard sur les chefs coutumiers et traditionnels. Elles peuvent ainsi prononcer des sanctions allant jusqu\u2019\u00e0 la d\u00e9ch\u00e9ance, avec l\u2019appui de l\u2019\u00c9tat si n\u00e9cessaire pour l\u2019ex\u00e9cution des d\u00e9cisions.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">La perte de la qualit\u00e9 ou du titre de chef coutumier ou traditionnel fait \u00e9galement l\u2019objet d\u2019un proc\u00e8s-verbal, transmis au chef de circonscription administrative comp\u00e9tent dans un d\u00e9lai d\u2019un mois, conform\u00e9ment \u00e0 l\u2019article 16.
