La juridiction n\u2019a pas pu examiner le dossier au fond en raison de recours soulev\u00e9s par la d\u00e9fense.<\/span><\/strong><\/p>\n<p class=\"p1\"><span class=\"s1\">\u00a0<\/span>Les personnes mises en cause, dont Camille Y\u00e9 Yak\u00e9, ancien directeur de la gestion des finances du minist\u00e8re de l\u2019Action humanitaire, sont poursuivies pour d\u00e9tournement de deniers publics, complicit\u00e9, enrichissement illicite et blanchiment de capitaux. Les faits reproch\u00e9s sont li\u00e9s \u00e0 la gestion du compte \u00ab Renforcement Prot-SOC\/MASSN \u00bb, destin\u00e9 \u00e0 l\u2019achat de vivres pour les Personnes d\u00e9plac\u00e9es internes (PDI).<\/p>\n<p class=\"p1\"><span class=\"s1\">D\u00e8s l\u2019ouverture de l\u2019audience, Me Adama Kangon\u00e9, avocat de Laure Zongo\/Hien, a sollicit\u00e9 un renvoi afin de mieux pr\u00e9parer la d\u00e9fense. Le report est surtout motiv\u00e9 par un recours en inconstitutionnalit\u00e9 visant l\u2019ordonnance de renvoi rendue par le juge d\u2019instruction et frapp\u00e9e d\u2019appel.Selon Me Roger Yamba, avocat de l\u2019un des pr\u00e9venus, \u00ab lorsque le proc\u00e8s a \u00e9t\u00e9 ouvert, les avocats de l\u2019une des personnes poursuivies ont soulev\u00e9 une question int\u00e9ressante en droit \u00bb. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Il a rappel\u00e9 que le Code de proc\u00e9dure p\u00e9nale limite le droit d\u2019appel de la personne mise en examen, contrairement \u00e0 ce que consacre la Constitution. \u00ab La Constitution dit que nous sommes tous \u00e9gaux en droit. Si nous le sommes, il ne devrait pas y avoir une partie qui a plus de latitude de faire appel qu\u2019une autre \u00bb, a-t-il soutenu.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Estimant ne pas \u00eatre comp\u00e9tent pour trancher cette question, le Tribunal a d\u00e9cid\u00e9 de surseoir \u00e0 statuer. Me Roger Yamba a salu\u00e9 cette d\u00e9cision : \u00ab Franchement, je tire mon chapeau au tribunal. C\u2019est une appr\u00e9ciation personnelle. Le tribunal n\u2019a pas cherch\u00e9 \u00e0 forcer. Ce sont des questions tr\u00e8s capitales \u00bb.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Justifiant la date retenue, l\u2019avocat de Josito Billy Zongo a pr\u00e9cis\u00e9 : \u00ab La loi donne un d\u00e9lai d\u2019un mois au Conseil constitutionnel pour se prononcer. Le 23 janvier 2026 est une bonne date qui co\u00efncide avec une session du p\u00f4le ECOFI \u00bb.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Face aux accusations de man\u0153uvres dilatoires, Me Roger Yamba a r\u00e9pliqu\u00e9 : \u00ab Non, il n\u2019y a pas de dilatoire. C\u2019est la loi qui a pr\u00e9vu (\u2026) La loi a pr\u00e9vu, on use \u00bb.En attendant la d\u00e9cision du Conseil constitutionnel et l\u2019issue de l\u2019appel, l\u2019examen du fond reste suspendu.
