Les d\u00e9put\u00e9s de l\u2019Assembl\u00e9e l\u00e9gislative de transition (ALT) ont adopt\u00e9, ce mardi, \u00e0 l\u2019unanimit\u00e9, la nouvelle loi portant <\/span>R\u00e9organisation agraire et fonci\u00e8re (RAF)<\/span> du Burkina Faso. Ce texte majeur, compos\u00e9 de <\/span>214 articles<\/span>, introduit d\u2019importantes r\u00e9formes dans la gestion du foncier national, avec une vision claire : replacer l\u2019\u00c9tat au c\u0153ur de la gouvernance des terres.<\/span><\/p>\n

La terre appartient d\u00e9sormais \u00e0 l\u2019\u00c9tat<\/span><\/strong><\/p>\n

La principale innovation de cette r\u00e9forme consacre la <\/span>propri\u00e9t\u00e9 pleine et enti\u00e8re de l\u2019\u00c9tat sur le domaine foncier national<\/span>. Autrement dit, la terre du Burkina Faso appartient d\u00e9sormais \u00e0 l\u2019\u00c9tat, qui peut en confier la gestion, en tout ou en partie, aux collectivit\u00e9s territoriales selon les besoins et r\u00e9alit\u00e9s locales.<\/span><\/p>\n

Cette disposition, selon le gouvernement, vise \u00e0 mettre fin \u00e0 la sp\u00e9culation fonci\u00e8re et \u00e0 garantir une utilisation plus rationnelle et \u00e9quitable des terres au profit de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/span><\/p>\n

Reconnaissance des droits coutumiers et baux de longue dur\u00e9e<\/span><\/strong><\/p>\n

Autre nouveaut\u00e9, la loi reconna\u00eet d\u00e9sormais les <\/span>droits coutumiers<\/span> \u00e0 travers la <\/span>d\u00e9livrance d\u2019attestations de possession fonci\u00e8re rurale<\/span>, un m\u00e9canisme destin\u00e9 \u00e0 s\u00e9curiser les exploitants traditionnels.
\nLe texte introduit \u00e9galement des <\/span>baux de longue dur\u00e9e<\/span>, allant de <\/span>18 \u00e0 99 ans<\/span>, pour favoriser les investissements agricoles tout en pr\u00e9servant la souverainet\u00e9 nationale sur les terres.<\/span><\/p>\n

Par ailleurs, <\/span>les \u00e9trangers ne pourront plus d\u00e9tenir de titre de propri\u00e9t\u00e9<\/span> sur des terres rurales, une mesure pr\u00e9sent\u00e9e comme un gage de protection du patrimoine foncier national.<\/span><\/p>\n

Expropriations d\u2019urgence et abrogation d\u2019anciennes lois<\/span><\/strong><\/p>\n

La nouvelle RAF <\/span>abroge la loi sur les proc\u00e9dures d\u2019expropriation<\/span>, dont les dispositions ont \u00e9t\u00e9 int\u00e9gr\u00e9es dans le nouveau texte. Elle pr\u00e9voit d\u00e9sormais la possibilit\u00e9 pour l\u2019\u00c9tat de proc\u00e9der \u00e0 des <\/span>expropriations d\u2019urgence<\/span>, notamment dans le cadre de projets strat\u00e9giques n\u00e9cessitant une mise en \u0153uvre rapide.<\/span><\/p>\n

\u00ab Il y a des projets importants pour lesquels, si l\u2019on veut suivre les proc\u00e9dures ordinaires d\u2019expropriation, cela peut prendre trop de temps et compromettre leur efficacit\u00e9 \u00bb, a expliqu\u00e9 le ministre de l\u2019\u00c9conomie et des Finances, <\/span>Dr Aboubakar Nacanabo<\/span>, \u00e0 l\u2019issue du vote.<\/span><\/strong><\/em><\/p>\n<\/blockquote>\n

Une r\u00e9forme pour corriger les insuffisances de la loi de 2012<\/span><\/strong><\/p>\n

Le ministre a rappel\u00e9 que cette r\u00e9vision faisait suite \u00e0 un <\/span>diagnostic men\u00e9 en 2021<\/span> sur la loi RAF de 2012, lequel avait mis en lumi\u00e8re plusieurs limites : faible implication de l\u2019\u00c9tat, accaparement des terres, lenteur des proc\u00e9dures et difficult\u00e9s \u00e0 mobiliser le foncier pour des projets strat\u00e9giques.<\/span><\/p>\n

\u00ab Les r\u00e9formes engag\u00e9es apr\u00e8s la RAF de 1984 ont entra\u00een\u00e9 une perte de contr\u00f4le de l\u2019\u00c9tat sur les terres. Cette nouvelle loi vient corriger cela et redonner \u00e0 l\u2019\u00c9tat son r\u00f4le central \u00bb, a-t-il pr\u00e9cis\u00e9.<\/span><\/strong><\/em><\/p>\n<\/blockquote>\n

Apr\u00e8s l\u2019adoption unanime des <\/span>71 d\u00e9put\u00e9s de l\u2019ALT<\/span>, le gouvernement entend d\u00e9sormais s\u2019atteler \u00e0 la <\/span>finalisation des textes d\u2019application<\/span> afin de rendre la loi pleinement op\u00e9rationnelle.<\/span><\/p>\n

Cette \u00e9tape sera d\u00e9terminante pour traduire, sur le terrain, les ambitions de cette r\u00e9forme fonci\u00e8re, jug\u00e9e structurante pour le d\u00e9veloppement agricole, la s\u00e9curisation du foncier et la stabilit\u00e9 sociale au Burkina Faso.<\/span><\/p>\n
