Cette clarification juridique d\u00e9coule d\u2019une ordonnance rendue le 27 juin 2025 par la Cour administrative d\u2019appel de Ouagadougou, qui a infirm\u00e9 une d\u00e9cision ant\u00e9rieure du Tribunal administratif suspendant l\u2019ex\u00e9cution de l\u2019attestation de renouvellement du r\u00e9c\u00e9piss\u00e9 du bureau ex\u00e9cutif national.<\/span><\/strong><\/p>\n<p class=\"p1\"><span class=\"s1\">\u00a0<\/span>A l\u2019origine de cette crise, un recours introduit par l\u2019Association Burkindi pour la Promotion et la Valorisation du Commerce (ABPVC), soutenue par huit autres requ\u00e9rants, avait conduit le Tribunal administratif \u00e0 prononcer une mesure de suspension, plongeant la fa\u00eeti\u00e8re de l\u2019\u00e9conomie informelle dans l\u2019incertitude. Mais l\u2019arr\u00eat de la Cour administrative d\u2019appel, enregistr\u00e9 sous le num\u00e9ro N\u00b0329-2025\/CAA.O\/GREFFE, a totalement chang\u00e9 la donne.<\/p>\n<p class=\"p1\"><span class=\"s1\">La juridiction, statuant publiquement, contradictoirement et en dernier ressort, a jug\u00e9 recevables les appels interjet\u00e9s par l\u2019\u00c9tat burkinab\u00e8 et le CNEI-BF. Elle a ensuite infirm\u00e9 l\u2019ordonnance initialement rendue, avant de rejeter le recours des plaignants qu\u2019elle a jug\u00e9 mal fond\u00e9. En plus d\u2019annuler la mesure de suspension, la Cour a condamn\u00e9 les requ\u00e9rants aux d\u00e9pens, sans qu\u2019il ne soit fait droit \u00e0 un quelconque paiement de frais suppl\u00e9mentaires non compris dans les d\u00e9pens. Le document officiel, sign\u00e9 par le Greffier en chef, a \u00e9t\u00e9 d\u00e9livr\u00e9 le 30 juin 2025 pour valoir ce que de droit.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Suite \u00e0 cette d\u00e9cision, le pr\u00e9sident du bureau ex\u00e9cutif national du CNEI-BF, Salifou Niki\u00e9ma, a r\u00e9agi dans une note adress\u00e9e aux membres, partenaires et sympathisants de la fa\u00eeti\u00e8re. Se r\u00e9jouissant de l\u2019issue favorable de cette affaire, il a salu\u00e9 la patience, la discipline et la solidarit\u00e9 des membres durant cette p\u00e9riode \u00e9prouvante. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Il a \u00e9galement exprim\u00e9 sa profonde gratitude envers les partenaires techniques et financiers qui ont continu\u00e9 d\u2019accompagner l\u2019institution malgr\u00e9 la situation. Salifou Niki\u00e9ma n\u2019a pas manqu\u00e9 de remercier les autorit\u00e9s judiciaires, estimant qu\u2019elles ont permis au droit de triompher et \u00e0 la v\u00e9rit\u00e9 de s\u2019imposer.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u00ab Le droit est dit et le CNEI-BF peut d\u00e9sormais d\u00e9rouler ses activit\u00e9s en toute l\u00e9galit\u00e9 sur l\u2019ensemble du territoire national \u00bb, a-t-il d\u00e9clar\u00e9, soulignant que cette d\u00e9cision r\u00e9tablit non seulement la l\u00e9galit\u00e9 du bureau ex\u00e9cutif mais consacre \u00e9galement la l\u00e9gitimit\u00e9 du CNEI-BF comme unique interface reconnue entre l\u2019\u00c9tat, les partenaires au d\u00e9veloppement et les acteurs du secteur informel.
